This Temporary Privacy Policy aims to inform users of the website www.kayphas.com (hereinafter the "Site") about how their personal data is collected, used, and protected when using our general contact form.
1. Data Controller
The Kayphas project is currently in its pre-incorporation phase and does not yet possess distinct legal personality. At this stage, the processing of personal data collected on the Site is under the joint responsibility of its founders:

As soon as the legal incorporation of the Kayphas group entities (specifically the holding company or its operational subsidiaries) is completed, data controller status will be automatically transferred to the newly formed legal entity, and this policy will be updated accordingly.

When using our contact form, we only collect information that you voluntarily choose to send us:
- Your name and/or surname;
- Your email address;
- Your phone number;
- If applicable, the name of your organization/company;
- The subject and content of your message.
We do not collect any sensitive data (political opinions, health data, etc.). Technical browsing data (IP address, cookies) may be collected by our hosting provider for security and basic traffic analysis purposes.
3. Purpose and Legal Basis of Processing
We process your personal data for the following purposes:
- Responding to your inquiries and managing general communication regarding the Kayphas project;
- Evaluating potential commercial or technological partnerships prior to the formal incorporation of the company.
Legal Bases: This processing is based on (i) your consent (expressed by voluntarily submitting the form) and (ii) our legitimate interest in responding to inquiries from parties interested in our deep-tech and battery technology project.
4. Data Recipients and International Transfers
The collected data is strictly reserved for the exclusive use of the founders of the Kayphas project. It is not sold, rented, or shared with third parties for commercial purposes.
Due to the global nature of the Kayphas project (aiming for corporate structures in Delaware, Canada, and Madagascar), your data may be stored, accessed, or processed by the founders located in these different jurisdictions. We ensure that our hosting and email service providers offer adequate security and confidentiality standards.
5. Data Retention Period
Your personal data is stored only for as long as necessary to process your request:
- General inquiries: Data is kept for a maximum of three (3) years from our last contact with you.
- Company incorporation: Upon the formal registration of the Kayphas entity, and subject to your right to object, your contact data may be transferred to the customer relationship management (CRM) system of the newly formed legal entity to continue our communication.
6. Your Rights
In compliance with international data protection standards (including the Malagasy Law No. 2014-038, the Canadian PIPEDA, and the GDPR where applicable), you have the following rights regarding your data:
- Right of Access and Rectification: You may request to know what data we hold about you and request its correction.
- Right to Erasure (Right to be Forgotten): You may request the deletion of your data from our files.
- Right to Object or Restrict Processing: You may object to us using your data to respond to your messages.

8. Amendments to this Privacy Policy
This privacy policy is temporary. It will be revised and replaced by the official privacy policy of the incorporated Kayphas entity once the corporate registration process is completed.
